Credit Defaults

Hi all,

Looking for some advice please with regards to credit defaults. It is my understanding that after 6 years from the date of the original default the debt is wiped (I've heard Martin Lewis say so myself).

I recently obtained a copy of my experian credit report which showed that the people I owed money to banks / finance companies are consistently changing the default date.

Is this allowed? am I understanding this correctly?

Any and all advice is much appreciated

    Do you mean they are changing the actual "default date" listed?

    Or just showing a series of 8s or Ds, or the "updated to" date changing.

    The actual default date.

    I don't have the copy of my credit report to hand, but having looked at it the original default date (which is much older than 6 years) always falls just inside of the last 6 year period.

    If they are changing that actual default date (below --->), then that is out of order and you need to complain.

    No it is not allowed.

    Who is the creditor?

    Make a complaint to the creditor and to experian. If you have a previous copy of your credit file showing an earlier default date then enclosing a copy of that in your letter can help speed up the process.

    Indeed, my thoughts exactly. Trouble is I'm not entirely sure who to complain to.

    Not to mention that I have no idea exactly who the supposed creditors listed on my credit report are!

    Plus there are so many different letters from collection agencies who I've never heard of claiming to act on behalf of people I've never heard of, all quoting insane amounts of "overdue" money.

    I realise I owe various parties amounts of money due to defaulting on credit agreements and there is honestly nothing I want more to clear my debt but honestly... I just don't know where to start.

    How can I go about clering this debt when there is nothing to say what is actually owed (i.e. amounts that don't include ridiculous fees and charges)??

    Sorry, I'll stop ranting now :p

    Complain to the creditor whose name is currently on your credit report for this particular debt (whether that is the original creditor or a debt collector).

    Presumably this is just one account / one default that you think the default date has been changed on?

    If you want to start repaying your debts and assuming the debts are not statute barred (see below) then when you next get a letter from a debt collection agency reply with the prove it letter - this will then require them to prove you owe the debt and give you details of the original creditor etc.

    Are you aware of the rules on statute barred debts / the limitation act? How long since you last made payments towards your debts?

    There is definitely more than one account, I'll look over the credit report again when I get home.

    Sorry but I'm unfamiliar with the "prove it" letter. Could you elaborate please?

    Any info on the statute on barred debts would very helpful also. It has been approximately 6 years since any payment was made.
