Restocking fee for non delivered item...

I ordered 40 railway sleepers, and had 20 delivered. We were waiting for the other 20 but they couldn't confirm a delivery date so was okay to hold the delivery until we could take delivery.

Wouldn't be so bad if they weren't less than a mile away, anyway.

We miscalculated and only need 25, so I called and asked for just 5 of the remaining 20 and they want a 15% restocking fee for the 15 sleepers.

Im right in saying they cant do this? They have lots of this in stock, its not ordered in or anything.


Just want to be clear as the first few levels in the company is being resistance and the managers aren't speaking to me yet.

    Wealdroam will know more about this, but I'm fairly certain that they can't charge a restocking fee.

    Drsquirrel, did you buy at a distance?
    Or did you go to their place to place the order?

    If you did not order at a distance, then they can charge the restocking fee.
    Essentially, you have placed an order and have now changed your mind. You are totally reliant on any refund policy they may have... you have no statutory right to change the contract once agreed.

    Really, all sales except distance sales, should be considered final unless informed otherwise.

    Railway sleepers ... who did you buy from, and was this a business contract? (Railway sleepers don't seem a normal consumer purchase).

    Depends what circles you frequent, lots of my friends have bought lots for their landscaped gardens, they make excellent raised beds.
    Thinking critically since 1996....

    I did go in sadly, so im stuck with these or without.

    Great for cross country jumps, building bridges, making stock pens, ramps for the car etc etc.

    You could always sell them on 10% cheaper than you bought them...
