Friend taking over my sofa direct debit

Hi, can anyone advise me please, my sister in law agreed to take my new sofa and the direct debit for payments when my partner and I split up. Everything was agreed verbally and all was going well til a couple of months ago. she has now missed a couple of payments and it is affecting my credit score, as the finance agreement is still in my name. Does anyone know how I stand, I have told her I want the sofa back, but she refuses to give it to me. I have thought about taking her to small claims court for the full payment of the remainder of the finance.

  • Because the credit agreement is in your name, you are liable.

    I doubt the court will award you with all the full payment because the debt is in your name.

    That is probably your only option and if she refuses then you are stuck.

    Seriously though, as it's in your name then, as above, it's your responsibility and she has presumably made payments in your name or given you the money to pay previously.

    If she has refused to pay ad you are thinking of court action then I guess you have burned your bridges as far as friendship is concerned.

    If she is prepared to cheat you like this then she might well tell the court you gave her the sofa as a gift and you will end up paying the court fees a well.

    Maybe the best option is to write a letter threatening court action and see if that is enough to scare her.

    You say she has now stopped making payments, implying she did make some for a while. Based on this she could claim part ownership of the sofa. If she was to be bloody minded she may return the sofa to you, less (for example) 18" chopped off the end, which is the part she has paid for.
