    Issue a Section 21 notice - search the forum for info on how to do it correctly as it comes up almost daily.

    After 2 months, you will be able to apply for court possession order to evict them.

    Even the "quick buy" companies are unlikley to take on anything with tenants, as it is a legal nightmare to get them out and they probably wouldn't even pick the bargepole up to touch them with!

    You could try an auction, but they would expect access and buyers are normally allowed viewings. I think eviction is your only option!

    I agree, the only way to get it sold, is to evict them. Serve a S21, then if they are still there after the required two months, go to court to get an eviction order.

    OR.....

    An easier / quicker path to getting them out may be to bribe them out. i.e. pay their deposit and first months rent on a new place?

    they have no sense of gratitude at all !! You let them stay based on trust - they dont deserve it.

    evict them and dont forget the lesson learnt

  • Thanks for all your replies. But are they not entitled to 'squaters' rights? The reason they wont sign it is because it cant extend a 12month agreement period and then It gives me a legal way of giving them notice? You can only imagine what they are like to deal with.

    1) Squatters don't have rights

    2) they are not squatters because they are there with your agreement and paying you rent. They do, in fact, have a rental contract with you even if you can't actually hold up a piece of paper saying so

    No, they are not squatters. Two things here:
    1] They paid rent, therefore they DO have a tenancy - just not on paper.
    2] Squatters' "rights" were removed last year and it is now a criminal offence to squat.

    Hi OP, I really think you might need some help with this, such as issuing the S21 etc.

    Again, I'd attempt to bribe them out as a first effort. Do you think they might go for this?

    Which country are you in; the law is Scotland is very very different.

    These "fiends" are tenants.

    Did you take a deposit of any sort?

    Did you do any sort of inventory?

    If in Scotland are you registered as a landlord?

    Have you got a Gas Safety Certificate?
    If you've have not made a mistake, you've made nothing
