Do all windows need kitemark glass (Fensa)

Hi all,
I'm in the first stages of selling my house and the usual question about post 2002 window installation has come up. I had a builder install a Wickes french door and upvc window in my kitchen about a year ago, he wasn't Fensa certified. So my choices are to either go the indemnity insurance route or to get the council round, but I wonder whether the work will pass the council guy test.
I rang Wickes and they reckon the door will pass all tests but the window was supplied by the builder and is not kite marked at all, does the window need kite marked glass, it is above 80cm from ground and not near a door?
Any feedback is most welcome,
