No Win No Pay Insurance

My son was a passenger in a vehicle that crashed a few weeks back. The back wheel hit the kerb on a bad bend and the car flipped, did a somersault and landed upside down. (the driver was 42, not a youngster, and passed breathalyser so was a pure accident). Thankfully they were all wearing seatbelts as police said they would all be dead otherwise. They managed to climb out through sunroof and they were all injured but not life threatening. My son had glass in his eyes, ears, up his nose. He had literally hundreds of small cuts, damaged neck muscles where the seatbelt held him in and other bumps and bruises. They were all taken to hospital by ambulance. My son had briefly been knocked out so was told he had minor concussion. They got most of the glass out but we were picking pieces of glass out of him literally for days afterwards. We had a phone call the other day from the driver's insurance company. They have said they would have offered him some compensation, but because the car had flipped, it was out of the jurisdiction of what they are allowed to deal with and he would need to get legal advise and sue them. Does this sound a bit odd? Ive never heard of an insurance company asking to be sued before. Should we see a solicitor, or should we go to one of these no win, no fee people because we really can't afford solicitors fees if they lose. Has anyone been in a similar position please. There are so many of those companies around nowadays and quite honestly, I thought most of them were just scammers.

    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    Specialist injury solicitors will act for you on a no win no fee basis.

    They will assess your prospects of winning prior to embarking on the case and as long as you are honest about all the circumstances you will not have to pay anything if they lose the claim.

    Didn't even think of compo tbh until the insurance company rang and said. They were actually ringing him to offer him compo, which I thought was a bit odd. I can't say Im particularly happy about it as I don't like this new compensation greedy nation that we seem to have become but then it wasn't me that went through it. It is up to my son at the end of the day what he decides to do, I just don't want him getting into anything that will cost him money.

    They may suggest that you use one of their panel solicitors and thus they control their costs to some degree through special arrangements with those solicitors - obviously the idea is that the probability is that you'll claim and if you do they may as well try and reduce the legal fees which often can come very close to the value of the injury claim in smaller cases.
  • seek advice from an INDEPENDENT solicitor, not a firm appointed by the insurers where the insurers are calling the shots.
