    I don't understand why people are saying that consequential costs aren't recoverable when assorted legislation make exclusion of consequential costs unlawful in consumer contracts.

    Hire company T&C not guaranteeing the exact make & model might work if they give you say a vectra instead of a mondeo but wouldn't hold water if they can't provide a car that you can legally drive as is the case in the auto vs manual example.

    Having said all that, enforcing it against a french company might be problematical so I'd be inclined to do the booking with a UK firm and use a credit card

    No, there isn't, hire companies rarely guarantee a group of car.
    There is no insurance, no other guarantee, no compensation for not getting the type you have booked.

    They may not need to guarantee a specific type of car, if the contract states the car type agreed and no other terms covering substituting the car then of course this could be considered a breach of contract.

    A blanket statement saying op isn't entitled to compensation simply isn't correct.

    You would need to read the terms of the contract op - but it is possible, assuming you mitigate your losses, you could recoup additional losses if they breach the contract and you have to source one elsewhere.

    Thanks Vaio and Arcon5 that is what I am after, does anyone know of any precedents in law for this?
    Would the credit card cover the additional costs or just the refund?
    Reason for an auto is that I am having a shoulder opp and my wife will be driving, she had a back opp a long time ago and her left leg goes numb when sitting. So although we both have licenses for manual cars an auto makes sense.
