Writing to Financial Ombudsman - advice please!!

Good evening,
We recently had our PPI claim refused from Nationwide :(. We had filled out a questionnaire online then I was contacted twice by a rather annoying lady from the claims dept who asked really ambiguous questions regarding our claim - and when she phoned the second time she asked me the same questions but phrased slightly differently as if she was trying to catch me out!!!!
We received a letter on Friday stating that the claim would not be upheld so we are now in the process of writing to the Financial Ombudsman.
We would appreciate any advice from anyone who has gone though the same - especially if the outcome was positive! - or any advice from the many experts on here that may be able to give us pointers/ideas to improve our chance of success :).

    Perhaps as you thought the first ones were ambiguous that they were not answered in a way they could really decide. They really do not have the resources to do it twice for fun!
    We would appreciate any advice from anyone who has gone though the same - especially if the outcome was positive!

    You need to give us some information about your complaint, what type of PPI, why it was rejected and what evidence you have to support your allegations.

    Thanks for your response.

    We were never given a quote over the telephone without the PPI included. We were never informed over the phone that it was optional and no questions were asked relating to our health etc or if we had other means of paying the loan should we lose our jobs. At the time of the loan we were both in full time employment - I would have received 6 months full pay and 6 months half pay if off work due to sickness and my husband 2 months full pay. We had £2000 in savings (although I don't have the statements to prove this as the account no longer exists) plus very supportive family with savings who would have helped us. Hence we would not have taken the PPI out if we had been fully informed of the terms and conditions and the inclusion/exclusion criteria.
    We were never told that the premium would be added as a single premium and that interest would be added on to this.

    Any advice greatly appreciated.

    Has anyone successfully won a MPPI case, especially with L&G?

    We didn't know we were paying this as it was built into our assurance policy. When we went to remortgage, this was taken out by our broker again.

    We only became aware of this when we again changed our mortgage, our broker brought it to our attention, but he too increased premiums, we thought this was necessary to obtain our mortgage through him.

    I sent my claim to L&G, but they rejected it, saying I understood what I had taken out, even though I found out lately we had a dual policy running side by side and that we were over covered. Taking out a mortgage, house and contents insurance and life assurance is all very daunting as well as selling a house!

    We sent our claim to the ombudsman, but they have written back saying they don't hold much hope of winning this case as they have had similar cases that didn't win..

    I think these MPPI's are no different from PPI's, so why are these cases not winning,in fact mortgage brokers were mis selling these as they were getting more commission, my daughter has recently taken out a mortgage and she doesn't have MPPI, are brokers not allowed to push these anymore.

    I would be grateful to hear your remarks and stories!

    If it's the mortgage brokers that are responsible for the 'mis selling', why then did you send your claim to L&G?

    It is. Yet the insurance is the least daunting part.

    The FOS stats show just 0.2% of PPI complaints are adviser cases. Most get rejected. MPPi is different in that it is the one PPI that is generally regarded as worth having. It is nearly always set up correctly (monthly premium) and is covering a major debt with lifestyle changing consequences if it goes unpaid (unlike loans and credit card). Today, MPPI is only one of two types of PPi still retailed.

    Adviser cases tend to have better audit trails and needs analysis as well. Something that rarely exists on non-advised cases.

    Absolute codswallop. The facts do not back that up.

    We sent our claim to L&G because our originally advisor had ceased trading.

    Most likely it was an L&G tied agent as that is the only way L&G would have liability for the complaint.
