Need Advice Please (Letters & Procedures)

Hi
I have my credit file now, i ordered it from Equifax for 2 pounds. I have marked on the sheets what is what etc, so i know where everything is. I have 11 debts in total on there, totalling about 5000 pounds, so the debts are small. All but two are defaulted, the other two are being paid perfectly. The actual defaulted debts are all old (4-6 years), and there all unsecured debts, like catalogues , credit cards, and mobile phone contracts etc.
Most of these debts i never signed for, as they were done online/by phone. And the rest may not have my CCA anymore, all these debts have been passed on and on to different DCA's.
I would like to clean up my credit file the best i can, by sending letters to all the debts, asking for my credit agreement. Paying them off wont really help me, because the defaults will remain, i have a default on here for 50 pounds! By Barclays Bank, when they charged me money for being a little overdrawn (on an account that should not of been allowed to go over the limit).
Before anyone asks why i dont want to pay them back, its because the defaults will remain, and they do nothing but break the law, with threats, harrasments, phone calls at 9pm!
I want to know which letter is the best one to send them asking for my CCA? Also, the ones that do not provide my CCA after 12+2+30 days, i want to know who to write to in order to get the entries removed off my credit file, i do NOT want to mess around writing letter after letter to the creditors, i want to write the one letter, give them the time they are allowed by law, then get the entries removed by writing to TS or someone, who will get the entries on my file removed?
I will send a 1 pound postal order with each letter i send to the companys.
Also, because the debts have been passed around, i dont know where they currently are, so can i just send all the letters to the original creditors? I have my file here, but they have been passed around even since i got this file last week!

To be honest mate you aren't gonna get the defaults removed from your file until the 6 year period is up. And if you acknowledge the debt I believe they have the ability to apply for another default or even a CCJ which will again stay on your record for another 6 years. Is it worth it for £50? :undecided

Hmmm, i dont understand why someone with over 17,000 posts, does not understand that a company can not put an entry on your credit file legally, without a signed credit agreement.
What im saying is, most of these companys will not have a signed credit agreement, therefor will have to remove the default and entry.
What im asking is, after 12 + 30 days, if they have not sent me proof of the agreement, they are commiting an offense, now, i want to know where to report them so that they have people chasing them to remove the entry from my file, as its ILLEGAL.
Can i have some advice on this please?

perhaps it is you who either doesn't understand, or doesn't want to heed the advice which was very generously given (and very politely put unlike your own response).
When applying for CCs online, before sending out the cards the companies post out a form for signature and return - so I don't think you can get away with that one.
With regards to the catalogue debts - I'm not sure how they work when setting up accounts online so can't offer any advice.
However, one piece of advice is please think about how you respond to others. Don't take this the wrong way but your post in response to southernscouser definitely comes across as 'snotty' - it may not be what you meant, but it doesn't help to get peoples backs up when they are taking time out to try and help. The advice on here is from personal experience - no one is a financial expert in the sense of qualifications etc. We are here from experience and shared guidance.
That said - I hope someone comes along with an answer you want to hear (as opposed to the advice you don't seem to want to take)0 -
Are you really trying to 'clean' your credit file or are you trying to avoid paying your debts. If all the debts are old (in your words 4-6 years old) then defaulted debts fall off your credit file after six years from the date of default!! So why bother? I said that in the nicest tone possible i can assure you.
You did not read what i wrote well enough, i am not going to be told i am not understanding it well enough by someone who was 38,000 in debt, and another person who is 58,000 in debt, when my debts dont even add up to 5,000.
What i am asking, in the nicest way possible, is who do i report companys to, when they are ILLEGALLY chasing debts? Thats all, thats it, very simple, there is not even grounds for an arguement in my statements.
Your right on one thing, its not what i want to hear, all i want to hear is the answer to my question, i dont want to hear opinions on things that i am not asking.
Sammy's was the only decent post in the thread, even if she did have a small dig at me about trying to get out of my debts, which i understand, please understand that these debts are all 4-6 years old, interest has gone through the roof, and yes i want them gone, so that i can someday get a mortgage, like everyone else
I wouldnt mind paying them off, if the defaults were removed, you see, if i pay them now, im acknowledging the debt, and the default will stay on my file for many more years to come, so its just not intelligent to pay these old small debts off, specially when 90% of them are chasing me illegally.

At the end of the day YOU have ADMITTED that the old debts ARE YOURS, but that you don't want to pay them off now as it is easier than facing up to things.
Personally I don't know the answer your looking for.
If your not interested in peoples advice and Just to JUDGE and PUT DOWN others as they have MORE debt than you but ARE FACING IT AND PAYING IT OFF, then I SUGGEST THAT YOU STOP COMMING HERE and get a life.
£5 of debt IS still DEBT, and southernscoucer is far more thought of than you. We are like family with the way we help and encourage each other.
I suggest that you talk to and PAY for a solicitor or accountant for the answer to your question.

I don't exactly know what you are trying to do but a default, unless removed by the creditor, will remain on your credit file for 6 years after the date of default.
I have personally sent CCA Requests but only to have the debts returned to the original creditor (not the DCA). In my case, which may be luck, 2 of the DCA's could not provide me with CCA's so have written off the debt and had the default removed from my CR with the co-operation of the original creditor. This does not happen often.
If, what you are saying is you don't want to pay your debts just because they cannot supply you with a CCA and so you can have the defaults removed, then I think it is morally wrong but thats just my opinion.
If you still wish to go ahead and report them then you need to contact TS, the OFT, the Information Commissioners Office, the CSA, the FOS and your local MP.

We will help you, that is what this site if for but if you do require help then please take others comments on board, we are all entitled to our own opinions, rudeness will just get you ignored. If you can prove that the companies are chasing you illegally for debts, then you can report them to the Office of Fair Trading and your local council's trading standard's department.

Next time you have a query for the board, perhaps you need to word it less ambiguously. Your initial post reads very much like somebody trying to duck out of their legal responsibilities.0
