Well the reason I don't know the answer is that I have not EVER tried to get out of PAYING OFF MY DEBT.
Just seems to me that your trying to get out of paying for DEBT that YOU have RUN up in the PAST.
Oh and I did not know that this WAS YOUR website, thought it was for anyone that signed up!!0 -
I wont apologise to anyone who insults me or my intelligents, infact people like that should not be posting in my thread, they are trouble makers.
All i was after was some friendly advice for my question, i think i have that now

DCA's break the law day to day, most of the people they chase for money, they dont even have a CCA for, and they still harrass and threaten them, if they have done the same to me, so if your asking me if i am trying not to pay them back, you can bet on it, all these old debts have been passed on, and i have heard every threat under the sun, and my file is confusing to me, by that i mean, i dont know what some of these debts are, i also dont know where to send the letters (because theres no company adresses on my file).
I dont get credit to not pay it back, i have a 3000 pound car finance on my file which has been paid back in full perfectly, along with an 20 month phone contract, never missed a payment.
The debts i am trying to remove, im removing because of the defaults, causing me problems even trying to open a current account at a bank to pay my car insurance by direct debit.
I am not going to do these DCA's any favours, the interest they add on is sickening.
I feel sorry for anyone else here who has had bad experiances with DCA's aswel.
My total debt amounts up to 4,800 pounds, not much i know, but i have never been one to go out and get lots of credit, ive estimated that around 35% of my total debt has come from interest they have added on!!
A 200 pound capital one bill, has turned into a debt of 675!
Anyway, to answer again, yes yepidy yep, i am trying to get out of debts that are being ILLEGALLY chased.
Ok, so if i report them to trading standards, will they chase the DCA to remove my entry?
My thinking on this is, if i put a debt entry on someones credit file from this board, without a CCA, i would HAVE to take it off, because its completely illegal, but how would you make me take it off? Report me? Sue me?
All im trying to do is set up a plan of action so that i know what im doing when i send the letters off you see

I am not here to cause trouble for anyone, I was just very angry at your reply to Southernscouser as what he had said was what I also believed to be the correct answer.

Ok, your talking more sense now, i dont feel i attacked anyone. My words may be harsh, but not in an attacking sense, im just trying to find the answers.
His answer was not the correct answer, because you cannot chase a debt without a true copy of a CCA, you just cant, its illegal, so i can get entries and defaults removed, if they do not have a true copy of my CCA.
That, is why i wanted someone elses answer, thats all.0 -

I don't know if TS will chase the DCA to remove the Default - it didn't get that far in my case, the DCA's and Creditors agreed to remove the defaults.
I would suggest you give Trading Standards a call on Monday to clarify the situation, they will be able to advise you further.

okay fair enough.....I might be £58,000 in debt but at least I am not trying to avoid paying what I owe and I have never defaulted on any debt. Put into perspective that figure is less than one year's earned income - but I know that it is, for me, an unacceptably high level and hence my DFW membership.
I know some DFWs on here have defaults and for various different reasons. They are genuine people, some who have just spent and spent without considering long term consequences, some with various situations that life has thrown at them. Whatever the reason they are here, they all (bar 1 - Matthew402007) hold there hands up and admit it and are trying, with the support of this site, to put things right. Some of those are taking legitimate advantage of the law and using statute barred and other clauses to not pay. They are doing this, and good luck to them, whilst holding there hands up and saying...yes it was my debt, but if the law is such that I don't have to pay it then I will take full advantage of said law.
and I respect them for that. The difference between them and yourself is the tone of the posts.

I do completely understand what your saying, and well done to anybody paying back there debts.
But for me, i would rather be intelligent, and use the law to my advantage, to wipe off a few small debts owed to companys who have the utter cheek to threaten there clients, and have an even bigger cheek, to chase a debt, when they know they dont have a CCA and are chasing illegally.
I am being intelligent about this, because if i pay even 10 pounds to one of my defaulted debts now, the 6 year clock restarts, and it will be a further 6 years before the default is removed, thats not what im going to do.
These companys do not care about me, and i do not care about them, this is business.
So when you attempt to make me feel bad about not wanting to pay the small debts back, it just wont happen.
Anybody who sticks up for these companys, all i can say is, wow.
They actually break the law, all im doing is using the law to my advantage. If you want to stick up for them, and pay them back, with all there interest and threats, go ahead, its completely up to you.
Can someone advise me if i should send the letters to the DCA's or orginal creditors please?
How do i go about finding the companys addresses to post them to?
