Letting Agent tenancy renewal issues

    I never got to stand my ground on this because my LL siudenly decided to have a change of circumstances and serve me notice (after I politely informed him we'd had a baby - my mistake!).

    However I would have informed my letting agent that I was going to go into an SPT and just dealt with their attitude safe in the knowledge I was £120 better off.

    Nice :( I hope they gave you the proper notice in writing and that your deposit is protected. Otherwise you could possibly take action against the landlord.

    Nice :( I hope they gave you the proper notice in writing and that your deposit is protected. Otherwise you could possibly take action against the landlord.

    He gave me notice by a one line email which in he case of a fixed term assured shorthold is all he needed to do. He can also choose any reason he wants and leave it suitably vague, ala a 'change of circumstance'. What he can't do, I think, is rent it out the day after we leave... or perhaps he can. Nevermind. My falt for mentioining the B word!

    Notices are only valid if there is proof of receipt. If you do not acknowledge that email then that notice is not valid. He can serve notice for whatever reason he desires, however notice must be served properly. If you provide some information we can tell you if the notice is valid, if the notice is not valid then you don't have to leave -- although technically notice doesn't force you to leave either, but morally it's best to leave when notice is served properly.

    What date did your tenancy start on? What is the exact wording of the email that he sent to you? Did you reply to the email? Are you in England and Wales, or Scotland?

    It depends whether you need/want to stick to your rights in terms of notice , deposit being protected etc etc or whether you just want to get out of there.
    From what you've said I'd be surprised if the notice he gave you was valid to be honest - if it isn't valid and he hasn't protected your deposit then this of course gives you more leverage and time to prepare for your onward move, as he'd have to reserve the notice and get it right.

    The private email from my Ll came in response to an email I had sent (to thank him for 'renewing' my current agreement), and I responded to it with a plea to stay or to stall our departure but haven't heard back.

    I think anyway technically he didn't serve notice because the email says that he has 'decided not to renew'. So in theory I could have gone on the assumption he wanted to roll our tenancy into an SPT :p - but I think we know where we're not wanted.

    It's a shame you replied to the email, however unless he is saying I hereby serve the required 2 month notice, which is to end on XX.XX.13, I would also presume it became a SPT.

    I wouldn't assume it was notice, and unless you hear otherwise, I'd just stay. It's not like he doesnt have the address to serve notice correctly! :)

    I would utilise today to contact the LA and ask them for details of the deposit protection scheme. Don't let them fob you off, this is important.
