Where do I stand in regards to my £100 deposit ?

Hi,
I paid a £100 deposit on a 2 & 3 seater sofa on Sunday 3rd March, I was told delivery would be 4 – 6 weeks, this was written on a copy
of the invoice I received on the day of placing the order.
After 8 weeks of waiting I visited the store on Monday 29th April and voiced my concerns about the delay and was told
It could be another 3 – 4 weeks max.
It will be 12 weeks this Sunday 29th May and still no sign of the sofas.
My questions are:
Where do I stand with getting my deposit back ?
Did I enter into a contract when I signed the invoice ?
I still have no firm delivery date for my order, where do I stand ?
Kind regards

I would go and ask for my money back. But of course you then have to order another so you could end up waiting another 12 weeks.
At least go in and read the riot act. I presume you have bought from one of the retail sheds, which is always a mistake.0 -

A contract was formed when you were offered a product/ service and you agreed to it and made a promise to pay (or did pay in this case).
Ultimately you need to carefully read both the wording on the front of the invoice re dates and any T&Cs that are on the reverse or on any other documentation they gave you.
In most cases delivery dates are considered a guidance only and are not a definitive promise and thus failure to meet the timescales is not strictly a breach of contract.
That said, getting stroppy with furniture stores in store where other customer can hear you talking loudly about false promises etc does tend to work wonders. When I had a similar problem my delivery went from "there's been problems and so itll be another month or so" to "we can delivery the day after tomorrow"0 -
You can also put it in writing. Keep it simple and straightforward.
You ordered x item on x date for a total price of x and a deposit of x was paid by cash/cheque/card. You were advised delivery would be 4-6 weeks, it has now been x weeks and you are not prepared to wait indefinitely. If they cannot provide the items as agreed by x date (give them at least 14 days imo), you will have no choice but to rescind the contract and they should refund all monies paid. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
I'd think you are well within your rights to rescind from the contract if they've failed to perform their side of it and be entitled to 100% back0
