ParkingEye - PCN

Hi - This is my first post: an MSE virgin! I received a PCN from Parking Eye re overstaying my welcome at South Mimms service station. I wasn't intending staying long at all and wasn't aware of the charges. However, I was suffering from kidney failure at the time and 40 winks turned into two hours. I have since had a kidney transplant so all is now well on that front.

I explained all this in my appeal to ParkingEye. I just received standard replies.

I have now read this in the forum posts:

Ticket in a private car park?... DON'T PAY IT! ''These supposed fines are the new Wild West - cowboys at supermarkets or housing estates - they're often unenforceable...they have no power to fine.'' (Martin Lewis).

Is this true? The letter from ParkingEye states: 'We can confirm that ParkingEye has the authority to issue and enforce Parking Charge Notices for contractual breach.' It then quotes various case law to support this position.

In the first instance I would like to write to the Managing Director of Parking Eye and plead my case. Searching the net it appears that the MD was Andrew McKerney, but he apparently resigned his position in December 2012. Interestingly - or ironically, depending on your viewpoint - his wife runs an evangelical website for women seeking the Lord. Does anybody know who is the current MD of Parking Eye?

Really enjoyed reading the earlier posts. Some great information.

    Despite your very serious health condition at the time, it's highly unlikely that you will get any sympathy from PE, just the nature of the beast, they only have two roles in life - [STRIKE]to manage car parks and[/STRIKE] to squeeze money from the unsuspecting public (sorry make that one role in life).

    In order to give you some more help you need to give us some more details (but avoid giving anything that might easily identify you - PE have people watching the forum and are possibly singling forum posters out for special attention).

    Was this a ticket (Notice to Driver) attached to your window via a parking [STRIKE]warden[/STRIKE] chimp or via ANPR cameras (Notice to Keeper)? Please give us date of 'contravention' and date of receipt of letter(s).

    After your first appeal to them, did PE provide you with a 10-digit POPLA code?

    In the context of your health condition there may be serious and additional issues for PE to face under the Equality Act 2010. Coupon-mad is the forum expert on the EA and I'm sure will be along some time today/this evening with more on that front.

    I think that will do for starters; let's have these details and we can get the ball rolling!

    In this case it hardly matters unless of course PE have had a whole string of appeals from people who have just had a kidney transplant:-)

    ANYWAY WHY DIDN'T YOU APPEAL AND JUST BEAT THEM AT POPLA? DID YOU TELL THEM ABOUT YOUR MEDICAL CONDITION? IF SO THEN THEY'VE NOW BREACHED THE EQUALITY ACT 2010 TO CONTINUE TO HARASS YOU!

    ILLEGAL harassment by PE. If you are out of time to appeal then complain & also complain to the landowner as they are also liable for the illegal actions of their agent.
