sports direct, will they refund?

purchased a case to be used for cabin baggage and on the label on the case it had dimensions as 50.5x34.5x19.5
when i measured the case its dimensions are 54 (56 including wheels)x37x16

quite a big difference and i would not have purchased if the correct dimensions were on the cases label. I know they are a bit funny with refunds but are they legally obliged to refund as the case was falsely advertised?

    Yes I would say so.
The product was labelled incorrectly, so clearly you are entilted to a refund or replacement.
Let us know what happens when you take it back.

They will point you to their returns policy, which will say you can't return it.

You need to point out the bit where it will say (and even if it doesn't it has to be true) "this does not affect your statutary rights" and tell them that you are returning it using your "statutary rights" as it is not "as described".

thanks that was the exact same suitcase in the other thread!
I returned item today and was told they weren't allowed to refund, couldn't be bothered to argue too much so ended up getting 2 smaller cases for a little more money!! Interesting that the store just seems so un-customer friendly though! Will not shop there in the future.

I won't buy from Sports Direct, customer service like Argos who think their policies override the law.
