Breach of contract??

Hi,

I have a question about a possible breach of contract.

OK, so I have a horse stabled on a yard, complete with contract etc. The yard was taken over a few days ago and they have told me and my friend that we have to out of there by the 31st May (they want our stables).

My contract (from the old owners) stated that they had to give me 1 months notice. The new owners told me that they wouldn't be renewing my contract. Does this mean that my old contact still stands then if I haven't got a new one, therefore 13 days notice isn't enough? I have only paid up until the end of this month, but can I claim 2 weeks livery back from them for early eviction even though I haven't actually paid it?

I don't think they will pay it anyway so I am happy to small claims them for it - obviously not if I wouldn't win though!

    Surely they must honour the previous contract until a renewal is due, i think you have a case against them.

    You have paid up to the 31st May, and the new owners are allowing you to stay until then.

    I do not think the new owners owe you anything.
    You have no contract with the new owners, do you?

    The old owners however, perhaps owe you two weeks money in lieu of notice, but i am not sure about that because they are not giving you notice.

    Now if this was a house you were renting and living in, things would be much different.

    Firstly, you have no contract with the new owners, so you don't have any claim against them.

    You do have a contract with the old owners and that has been breached because they've broken the contract to give you a month's notice to vacate.

    So you "may" have a claim against the old owners.

    BUT, the claim is only for the extra costs that you incur because of their breach of contract. So, what extra costs are you going to suffer because you've got to vacate and find a new stable on 31 May as opposed to having to vacate a couple of weeks later. Probably very little, if anything, so therefore nothing to claim for.
