My problem seems to be that my original lender is now reporting my account as 6 months in arrears even though the default date was 18th April 2007!

    When was the account settled?

I understood the default notice will be removed from CRA wether the debit paid or partially settled after 6 years from the default notice issued by the lenders ? unless the lenders try to redate it again .

They should not redate or remove the default. If they do then you complain to the lender, the ICO, the FOS and so on.

Stick to your guns, equifax are totally incompetent they told me the same. 6 years and 2 weeks it took to sort them out. They take things at a snails pace.

Equifax removes. Not dependant on the creditor. Experian and Call credit also remove expired data themselves. They do no ask the creditors permission or wait for them to update.

The OP should respond to them with a link to their own Personal Data Management Policy and quoting the relevant part of the text, as you have.

  • This is not good, im in rented accom waiting to be able to apply for a mortgage but I have to wait until the defaults expire on 11th September....I was hoping to apply on 12th September for a mortgage as it will be over 6 years.

This is not fair as it affects my whole family and I may have to extend renting until i get it cleared.
