Faulty tap...

Hi there, I bought a tap off of ebay last month, it has started leaking quite badly from where it comes out of the worktop (not the actual place where the water is meant to come from)
The seller has offered to refund me but what I was wondering is I've obviously had to pay for a plumber to install it and will need to get him back to remove it and fit a new one. Am I at all entitled to any of that cost back or is it just one of those things that you don't get reimbursed for and too bad?

    If you'd bought it from a store, you may be entitled to claim for consequential losses. If you just bought it from an individual on eBay, you're more than likely out of luck.

    Is the eBay seller a business, or a private individual?
    If they are trading as a business you may be able to claim the cost of having the tap removed and re-plumbed, and any other costs incurred that would not have been if the tap hadn't developed a fault.
    In the first instance, if the seller is a business, you can contact them with a list of provable losses (you cannot claim for "inconvenience", only clear, provable losses such as plumber costs) and ask them to reimburse you.
    If they refuse, you can issue them with a letter before action and, if no luck, you can initiate small claims proceedings.
    Also, when calculating costs, get several written quotes for the work so you can prove you tried to mitigate your losses. If it gets to court, this is something a judge would expect you to do.

    I bought a tap off eBay about a month or so ago too. I mean, they look good quality (the one I got anyhow), but when you consider I only paid about £23 when a similar one from where we got the bathroom from was in excess of £60-£70 then, I think perhaps, it's maybe a case of you get what you pay for?

    But, of course without knowing the one you got etc, how much you paid etc, it's hard to say.

    But yes, the advice given above is very good, and if it's a business, then hopefully you should be able to claim back your expenses.

    Same thing happened to me. I had a nice white swivel spout one. The tap leaked on the bottom of the swivel part. It was ok the first week then suddenly started leaking. I suspect a washer had jumped off but the plumber wouldn't look at it and said it was a duff tap. He put a new tap on and I had him back three times as then a pipe leaked. I was fed up with it and stuck a bowl under to catch any drips and that's how it stayed.
    Never thought to tell seller as I had given good feedback and suspect mine wasnt a tap fault, just a washer. be interesting to see how you get on.

    Thank you everyone for your help, the seller is a business on e-bay and I've been speaking with him again, he's going to send me a new tap today on next day delivery but isn't willing to pay for any subsequent plumbing that has had to be done.
    Someone said you get what you pay for? sometimes this is true, but the tap we had prior to this one was supplied by Magnet when we got our kitchen installed just over 2 years ago, a specific part inside the tap had to be replaced 4 times in that 2 and a half years, which the suppliers never charged for but again we had to pay for a plumber to fit, that tap cost over £650!!! so feel slightly better about my £40 tap from e-bay lol

    thanks again everyone, might e-mail him again and see if I can't push for an hour of the plumbers time

    Yes, I guess the saying you get what you pay for doesn't always apply, I was just wondering if maybe because there was such a price difference (going off my own experience), that maybe the quality wasn't as good? Although, having said that, my tap does look good....touch wood! :rotfl:

    They are a bit sneaky in these places, I was asked to chose the bits I wanted like taps, sink etc but there were no prices for me to see!!
    I now make a point of asking before I commit to anything :embarasse
    Lesson learned lol
