Im currently going through a transfer of equity with same lender and they requested a re-valuation.. so even staying with the same lender doesnt avoid such fees!.
My ex is keeping the same mortgage deal just removing my name from it so not incurring any survey costs, just land registry fees. I guess it depends on the lender.
Legally I don't think there is a 'rule' as such, it is just down to what you agree. But I would say the person moving out is going to be at a disadvantage already as there are the costs of moving, and assuming you are not moving in with someone else, a deposit for renting or costs of a new mortgage to deal with.If I cut you out of my life I can guarantee you handed me the scissors0 -

No, a full Survey as if she was buying another house on the open market.
Not only that, it is with the same Bank.0
