Bumper damaged by courier

    Take them to court...
    T&Cs don't absolve them of their duty of care.
    Incidentally, have you tried a claim through TNT? Legally you have no contract with them, but it's worth a try. Not least of all to make them aware of a) the negligence of their staff and b) their failure to adhere to the BIFA regs.

    Waste of time taking them to court, it will come out as unsuitably packed (which a bumper, only wrapped in bubble wrap is).

    Most bumpers are transported requiring painting after delivery, expecting to wrap a bumper in bubble wrap and have the paint arrive in pristine condition is just not right.

    If you wanted it to arrive without paint defects it needed to be in a crate.

    However the fundamental issue is that it was carried incorrectly. Also, by Paisley Freight's own guidelines, it was packaged appropriately

    Car Exhausts, Car Interiors, Car Bumpers, Roof Boxes, Roof Bars, Side-skirts/Spoilers and Car Seats Goods need to be fully enclosed with bubble wrap and cardboard with an address label on each parcel.

    I was referring to TNT not paisley freight on the basis you advised the OP to go to TNT.

    For paisley freight a quick Google says there isn't much hope in chasing them through the courts...

    You can have a shot at TNT. They owe you nothing as you have no contract with them, however, they may offer you something as goodwill. Be polite though, and don't go in all guns blazing, as they owe you nothing.

    Failing that, the best bet is a letter before action to Paisley Freight, and if they don't reply favourably, then you can decide whether its worth taking it to court.

    TNT replied stating that Paisley Freight have told them that any problems need to be dealt with them. Ahh :/

    Yeah I know. Not sure I can do anything now apart from court but doubt that will get me anywhere :(

    Like previously said, the bumper isn't damaged from what you've said, just the paint finish. Get it sprayed and move on, at best all you would get is your shipping cost back, but that's if you win, unlikely and then you've got all the costs of court etc to cover.
