Hi,
Hoping to get some POPLA advice please. We received a PE ticket whilst parking in a retail estate car park. The free allotted time is 2 hours and we over stayed by an hour. Appealed to PE and as expected this was declined and a POPLA code sent. Just wanted some advice on the appeal.
The car park is very large and I have never seen it full even at Christmas. On the day we parked it was probably half full so I cant see how they can claim a £100 in losses. I've heard that they are issuing more court papers so feeling anxious about it but really would prefer not to give in and pay as it seems to me to be a complete scam.
Any help or advice gratefully received.

Any extenuating circumstances under the Equality Act such as elderly passenger, disabled person, someone with a long term condition, a baby being fed?
As a general guide, you need to read other threads on the forum but DO NOT word this appeal the same as before as it's not about what happened on the day.
Show us your draft please if there's time. Start by looking at the POPLA decisions thread at the top of the parking forum to see the latest 2 wins added recently.

As you can see it's NOT a matter of sending any old soft appeal about 'what happened'. It's about challenging the very basis of the fake PCN and the status of the company to even issue it. You can do this just by copy/pasting stuff and showing us your draft you come up with, please, to make sure you've included everything.
It's a good game to find the legal or BPA breach point that will trip up your PPC - use strong legal challenge points you will see used on those threads (all started by inexperienced newbies who have learned quickly how to defeat the scammers).
Let's see what you have cobbled together form the links provided; not your appeal as before but your challenge based on those links.

We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

No trick question here, just that by my thinking, these these people have no legal basis for making this charge, then why would it be a good idea to go through the POPLA appeals process?
Someone mentions in one thread that the result of the appeal process is not binding.
Engaging with them in any way seems to legitamise their process. Why wouldn't it be better to ignore all communications right from the off?

The POPLA process, if appealed on the correct basis, will get the ticket cancelled almost every time, so this is now the advice given for most tickets.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years.
