Help problems with tenant and letting agent

Hi

I am a new landlord having let my flat out due to moving city for work. I went with a letting agent who are managing property. I received an email saying the had a tenant to move in he was in full time employment, he would have his 16 year old daughter staying at weekends etc. i felt this was ok and agreed a date. Two days after this i received a phone call asking if it was ok if he moved in the following week. I said he was already supposed to be living there I was informed that there had been a hold up with paper work. They had sent me an email I told them I was having trouble with my email but that was fine. The next week when my email was up and running the email informed me he had failed the credit check, had no guarantor and his daughter would be living there ( he works away most of the time. By the time I received this he had moved in.

He was 2 weeks late with the first months rent the LA never contacted me to let me know I had to phone them. His brother came in and paid. This month he has not paid and is now three weeks late. Again I had to phone them when I did not receive payment. They have spoke to him on the phone and he keeps arranging to go in and pay then doesn't show the LA are not communicating with me and fail to phone or email when they say they will. I have sent an email informing them of the above and it was ignored. I phoned and I was informed someone would go round to the property today then they would contact me again no word from them. Just wondering if anyone has any advice on what steps to take next.

    1) wait till the arrears are = 2 months rent, issue a S8 Notice, and evict.

    2) sack the letting agent and select a new one more carefully. Ensure they communicate with you at every stage and take no action (ie issuing a tenancy agreement in your name) without a specific instruction from you.

    Write off the costs/losses and move on, older and wiser.
  • Thank you that is what I'm planning to do. But I'm wondering if he does pay the rent this week I wouldn't be able to issue the S8. I'm aware that you can evict for persistent late payment but not sure that 2 months would cut it!
