Hi guys, could anybody please give me some advice or help please?
Basically June time last year me and my wife made a mirror will with the will writing company Milton Keynes, we paid 200 pound and that surprise to include storage and unlimited amendments which at the time sounded good as we don't really know to much on wills. Everything was done witness sighed and sent back to the company which is basically a one man band, only last week may 2013 we revived our will in the post saying the witness sighed the dates wrong, to which we was quite shocked that they had it for nearly a year and spouse to checked them when sent back, so has the will been invalid all this time?? We was very disappointed with this and it took us a week to get hold of the guy, we explained why we was upset and why wasn't this done sooner etc, he came up with post office fault and other excuses we said we would like a refund as its been invalid for nearly a year and he sound very angry and told us to take him to court when we was very calm and just wanted an explanation. Could anyone tell me where I stand on refund etc spoke to citezens advice and try said bout small claims court. I just don't know where we stand with the witness date issue does it make it invalid. Any help would be great thanks

Why do you want a refund when he will put it right for nothing?
Just make sure you sign the new will, date it correctly and have the witnesses (nb plural) sign and date correctly as well.
Depending on what the dating error was it may or may not have been invalid, but potentially it was.
Your reference to witness, singular, is of more concern0 -
It's mainly as it wasn't check when we sent it back. Just scary if anything happened and it being invalid. Thanks for you advice0

Our wills cost a similar amount using the solicitor that we use for house purchases and other things we have done over the last few decades.
Did you not have a similar set up?
In terms of this, he provided you with a service, your witnesses messed up. Yes it would have been good to check it when it got there, but really it sounds like he is a typing and storing service and that is what you have had0 -
Good luck with his one...But you made the mistake and in reality you have fallen for slick marketing because they will just be a storage facility that you have done all the written work for.. You forgot to read the small print..It is nice to see the value of your house going up'' Why ?
Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
If you are planning to upsize the new house will cost more.
If you are planning to downsize your new house will cost more than it should
If you are trying to buy your first house its almost impossible.0
