CPP Car Park Fine

Hi

My partner has just received a letter from CPP, Northampton for an alleged violation in January 2013 in the car park at Sheffield Children's Hospital. We remember the date as our son was having a major operation at the hospital that day. The claim is for £80. There was no ticket on the windscreen when we left Sheffield.

I have called CPP and all you get is a line that confirms the car reg and invites you to pay by card - so I don't even yet know what the alleged violation is.

Also, the car is a motability vehicle owned by them - registered keeper is my partner Mrs H Jones - yet the letter is addressed to 'Mr H Jones'. There is no Mr H Jones at this address (and my surname is not Jones).

The letter states that they will be taking the matter to County Court.

Any advice please?

    So your name is not jones yet they are writing to you as if you were, if this went to court it would go nowhere IMO

    Anyway I would make a complaint to the trust about this, they are in breach of the Equality Act 2010, but they don't know that until they get your complaint. As for the scammers I presume you've had this first notice more than 56 days after the event yes ? If so they are out of time for this scam
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    OK do not ignore it, that's OLD ADVICE and I am surprised to see it still given when you have said this was the first letter.

    They are not allowed to ticket a disabled vehicle if it was showing a 'Blue Badge' under the terms of the BPA Code of Practice.

    And if this is the first letter, the first 'Notice to Keeper' then they have missed the deadline big-time. Read this:

    And send an appeal (still not saying who was driving!) stating that they've missed the deadline to send the Notice to Keeper and so you have no liability to them. Also the car is clearly a zero-tax-disc motability car and under the Equality Act 2010 they legally have to make reasonable adjustments for disabled people, yet the letter doesn't even inform you what they allege the 'contravention' was supposed to be all those months ago - and this letter is the first you have heard of it so you can hardly be expected to guess. Add a final sentence, to the effect that to 'ticket' a car with a Blue Badge is against the BPA Code of Practice and you will be pleased to show all these breaches to POPLA at CPP's own expense.

    Finish by demanding a POPLA code if they will not cancel. And print the name 'H Jones' at the bottom, no clue about Mr or Mrs...


    Then come back here for help with the POPLA appeal, the wording is important.
