MBNA - Amazon Card - Charges reclaim

I have an amount of late payment charges on an amazon card for which I now need to make a court claim. FOS was a complete waste of time and turned me down flat despite previous success with this route

Could someone advise if the guide and the template poc for reclaiming on credit cards are still valid please?

In terms of the interest rates I have been through the website and find that there is only really one for purchases at 1.3133% - is this the correct rate to quote

There are no other issues beyond the charges so I assume that Moneyclaim online can be used

Grateful for any advice as I have never had to do this in terms of credit card charges before

Yes the article, and in particular the template poc, are still valid.:)

However, I presume you have asked the credit card company itself already and were declined. Why?

You also imply you were blown out by the FOS. Why?

In the circumstances, have you considered if you actually have a valid claim?
I would suggest you read the following article too:
    http://www.moneysavingexpert.com/reclaim/small-claims-court

    As it starts off:

    Ask yourself the questions:
    - Have I been genuinely wronged?
    - Can I afford the process?
    - Is it worth it?

My charges are standard £12 charges. MBNA merely stated after correspondence that this was standard charge as defined by t & c's. FOS said the same based upon what MBNA had told them was a pre-estimate of their costs based upon 2009 correspondence. They have stated that the law does not require a precise calculation

So what makes you think you have been genuinely wronged?

Both MBNA and the FOS are correct. On what basis do you believe you have a claim?

I think you're going to find yourself out-of-pocket if you take this to court.

I think the advice you were given by dunstonh over 2 years ago regarding late payments on your mortgage account equally apply here

    https://forums.moneysavingexpert.com/discussion/2997206

Perhaps your efforts would be better placed reviewing your money management with a view to paying your debts on time?

How does a pre- estimate of charges in 2009 based on an average relate to the actual charge on what was on an automated online account in 2012 for a payment which was a day late ?

You're right, it doesn't - you would expect it to be higher three years later.
