WTC and disabled partner

Hi all. We were receiving Working Tax Credit of 77p.w. last year from when I claimed (February) until April. It has recently gone up to £80p.w., but today we got a letter saying that we no longer qualified and we owe them about £400.
I was tempting when I made the claim and my husband was on Incapacity Benefit. I now have a permanent job and he has DLA as well as IB coming in. I told them of these changes as they happened.
When I phoned the Helpline today to ask why we're no longer eligible the chap said that because my husband is not working then we don't qualify for any WTC even though I'm working!?
Having checked various other sites it seems that we ARE still entitled to WTC. Can anyone 'in the know' shed some light on our situation?

I am sure someone will be along soon who can help you. You could try ringing again and speaking to someone else and query why you are no longer eligible.

You need to find out if the reason for it stopping was due to an over payment of tax credits.
To qualify for working tax credits one or both of you need to be working more than 16 hours. Is your partner getting higher rate or middle rate care componant?
Did you keep copys/record of when you informed them of the changes?

Hi i had all this last year about who qualifies for the disability element of WTC and to be honest i gave up in the end.
My husband works and i receive long term incapacity benefit but according to tax credits both of you need to be working ,so they said i need to work 16 hrs or more and claim incapacity to be entitled.
I explained to tax credits that i did not understand it when they say i need to be working as i would not qualify for incapacity if i could work.
If you become any wiser about who qualifys please could you respond as i would also like to know the answer.0 -
Hi to qualify for the disability element of tax credits you need to be receiving DLA either middle or higher rate of the care componant not sure about mobility side of it and only one of you need to be working if you have kids! We have no kids. He gets lower rate mobility and middle rate care DLA. I work 35 hours per week.
I've not kept records of when I've contacted them, but I have about 4 different award notices for the last 4 months because of notifying them of changes.
I'm pretty clueless TBH. Once I receive my P60 and can fill in the annual review then maybe I can get it looked at again.0 -
I'd call them again and ask why you're not eligible. It could be that as you have no children and you are working those hours you are above getting anything. Have they got the right details on all the award notices you have? Ask them if your renewal pack has been sent out too.0

Well, I've eventually managed to work out our earnings for last year - what a hassle (I've had 4 jobs! Temped for a while...)
Phoned them up to check what's the situation filling in the Annual Review and it turns out that our claim was ended because there was a gap of more than 7 days between one of the jobs and another. We should therefore 'provisionally' be entitled to £79 per week. Hopefully this also means that we won't have to pay anything back for last year (they want £388).
