    Only if you have GIVEN him the money rather than saying you will give him the money.
    The contact is till end Sept so you have to pay him 4 months rent,get agreed inventory, THEN get your deposit back.
    That is how it works in a CONTRACT!!!

    How can I give someone money I can't get hold of? The letting agent won't take it?

    To be honest and this is a whole new post that been covered many times already but I don't see the contract should be worth the paper it's written on if the LL doesn't pay his Mortgage/tax/ have consent to let/ make necessary repairs and doesn't leave his tenants with the Peaceful enjoyment of the property but leaves us hounded by Debt collectors!!

    I am a good tenant. I've paid on time and made improvements to the property but that counts for nothing when you have a dodgy Landlord it seems!
  • Far as I can see, all you can do is notify (in writing) that you are no longer in residence and that you will continue to pay the rent until it no longer becomes due.

    I'd probably check the post on a weekly basis looking for the inevitable repossession letter, turn up in court and tell the court/bank that you can leave immediately.
    The smaller the monkey the more it looks like it would kill you at the first given opportunity.

    New developement. The LA just called asking for access to the house as the LL wishes it to be valued to sell.

    Any advise?

    Now the ball is in your court.

    Sounds like the LA intends to resolve his mortgage problems by selling up, which seems to imply he's looking to get out of the situation, this gives you lots of leverage. Tell them that you do not consent to access by the LL or any person he authorises.

    "Due to the lack of contact, acknowledgement and professionalism from the LA I am not confident that the LA will deal with access in a proper manner, therefore I am unwilling to allow any access to the property while the tenancy continues. I am willing to terminate the tenancy as of (Date) which will allow the LA to conduct a valuation and viewings at his discretion."

    Also change the barrels of the locks if you haven't already, if they know it's empty they'll let themselves in.

    ok. This strengthens your negotiating situation. Offer to forgo your right of quiet enjoyment and assist them in selling the property by pointing out the positive aspects of the property. Explain nicely that because of this you will expect agreement with the early termination.

    If no such agreement can be reached then unfortunately no viewings can take place until after September when the tenancy ends.

    You need to now write a letter stating what you have said so that you have written proof. Or it could turn into your word against their word situation.
