    The OP's final pay I am assuming has been paid hence the letter saying we have over paid you

    The employer can not recall any payroll now

    When the employer is the same bank as the account that the salary has been sent to this may still happen.

    There are few checks on names just account and sort codes

    I would not be suprised if the OPs employment agreement allows for this.

    if the employer decides to do this is another issue and the fact it is someone elses account will get sorted later if it happened.

    the bank where the payroll has gone is not the employees account and I am sure that will not look good if they tried to do that to a NON employee.

    The friend has not signed anything (I am sure) that allows deductions

    They have debited the account and put it over drawn, I have called them and they just are not interested. I appreciate I owe them the money but they have given no notice, I would have thought they would have at least had to give say two weeks notice to allow time to get the funds together

    I suggest your friend, the account owner, speaks to the bank at her branch and complains about an illegal withdrawal from her account, asks for it to be re-credited immediately, and if not make an instant complaint to the financial ombudsman. This cannot possibly be legal.

    The agreement surely as I have said must have only to have the salary paid into and can not hold the OPs friend responsible for any over payment to the OP.

    I would be furious as its left the ops friend overdrawn and I am sure its not legal at all.

    There is a good chance that the account holder signed to say that if the bank deposits money by mistake they can take it back.

    Check your own current account T&C's.

    The employee contract could well have a clause that says that you have the account holders agreement(on accounts that are not your own) that the company can take out overpayment passing the responsibility to the employee.
