Over Payment Of Salary?

Hi,
I have recently left my job with an employer who is one of the big 4 banks and they have sent me a letter stating that they have over paid me. I was just wondering if they have the right to debit this direct from the bank account, my salary was being paid into my friends account because they state they will only pay salary into one of their accounts and I never have banked with them so it would be paid to my friends account and then she would transfer it to my own bank account. Although I appreciate any over payment has to be repaid currently do not have what they have calculated as spare cash and they have given me no reasonable notice of this, but my main concern is I don't want them to just debit my friends account and take it over drawn.
Any help or advice much appreciated.

Id be asking them for some kind of proof you were overpaid.
How come you didnt notice the overpayment at an earlier date ?
Just have to ask why didnt you open an account with the bank ?0 -
I had a computer through a company scheme and because I have now left they apparently take all that is owing, however I thought they would contact me and arrange payment through me or set up a direct debit. Can they legally take funds out of an account thats not in my name? I didn't open an account with them because I was happy with my bank as I have built a good score with them and have my overdraft with them etc.

I have a of through a company scheme and the balance is payable on leaving the Group. As per the contract agreed when I took it. So they should have deducted it from final pay.
I would call HR and explain the situation, they might let you pay in instalments or give you some breathing space to get the cash tgether. If you aim for the moon if you miss at least you will land among the stars!0 -
I'd be amazed if this isn't covered in your contract, and I would expect them to have the right to debit the salary account. I also think you've been pretty fortunate to get away with using someone else's account for the entire time you were there, pretty poor checking on the bank's part.
I think you need to get the money together somehow and put it in your friend's account pretty quickly, otherwise they could end up overdrawn because of your actions.0 -
No one can take any £ from anyone's bank account unless you have set up a SO or DD etc
You worked for a bank and you are asking this?!
How do you think they are going to take this £?We’ve had to remove your signature. Please check the Forum Rules if you’re unsure why it’s been removed and, if still unsure, email forumteam@moneysavingexpert.com0 -

Banks can take money out of accounts if they have permission it's does not just need s SO or DD ther are other set off situations.
The (payroll) deposits can be backed out(if done soon enough).0 -
The OP is not asking about payroll though they are asking about taking money from a friend acct.getmore4less wrote: »Banks can take money out of accounts if they have permission it's does not just need s SO or DD ther are other set off situations.

I think getmore4less was referring to the payroll payment being reversed and then re-credited correctly.
OP, I would read your contract and call HR tomorrow. Also, the contract you signed up to when you took the PC.If you aim for the moon if you miss at least you will land among the stars!0 -

Ooops sorry! I understand what you are saying now.
I was suggesting Payroll might not 'care' that it's a third party account, they will just recall their original transaction and re-pay it. Regardless of the account owner i.e. a different scenario to the original question.
However, you're right the OP is concerned the payroll might make a call to remove funds from their friends account without warning. Which is why I think they need to talk to their HR department tomorrow. If you aim for the moon if you miss at least you will land among the stars!0
