Samsung advice please!

My Samsung Galaxy S3 developed a problem after I unplugged it from the charger - the screen went totally black. I contacted the manufacturers directly and sent the phone off to the samsung repair centre to be fixed. About a week later I received a letter saying that the cost of repairing the phone would be £138. I was shocked as I was assured by Samsung the phone would get repaired free of charge due to the fact the handset was still covered by the warranty.
I rang the repair centre who told me that the phone had overheated which had caused the inner LCD screen to crack. Due to the physical damage from the overheating the phone was no longer covered by the warranty and I would have to pay. They acknowledged that the fault was not an error on my part.
Immediately after I rang Samsung who again told me that crack screen meant the warranty was void. I am still paying the contract for a handset that I am unable to use - through no fault of my own. The galaxy S3 simcards are smaller than normal and therefore don't fit into the spare handset I have. I would totally understand if the fault was caused by my personal misuse or neglect, but the service centre said themselves it was due to the phone
over heating.
Anyone got ideas about what I can do?!
Thanks!

The warranty is with the phone vendor .
Phone has overheated user or users equipment at fault = no warranty fair enough .
But Samsung are saying are they ???
>>>They acknowledged that the fault was not an error on my part <<<
Suggest you contact Trading Standards .

The repair centre acknowledged the fault wasn't mine, Samsung and the phone vendor are unwilling to help because the nature of the damage has made the warranty void. I'm stuck basically, having to pay for an expensive phone repair that wasn't my fault!

You are not stuck because you have consumer rights; sale of goods act to be precise. Warranty is on top of your consumer rights and you probably found out by now that the manufacturers can put any restrictions they want in the terms and conditions of the warranty.
How long did you have the phone for! If it's over 6 months then the onus is on you to prove that the phone had an inherent fault.0 -
I only had it for 3 months before it happened. I'm not sure how I can prove it was an inherent fault though? Like I said the repair centre said they thought it had overheated by that's not necessarily proof.
Thanks for the advice0
