Unauthorised direct debit

Lloyds incorrectly paid money onto my Lloyds credit card, though at the time when I queried the payment and said I wasn't sure it was my money they were unable to tell me where the money had come from. I closed the account, as I had planned to do before receiving this payment and they sent me a cheque for the balance of the account. Three months later they realised their error, re-opened my account and helped themselves to the minimum payment from my bank account from a direct debit apparently set up shortly before I closed the account (although I have no recollection of setting up the direct debit). As I had cancelled my agreement with them it seems to me that at the time I did that I also revoked any right they had to take direct debits from my account. Does anyone know whether their actions are legal or not?

  • If you signed a direct debit then you have given authority.

    Did you sign a direct debit? Ask for a copy.

    Did you cancel the direct debit? If you did then LTSB will have a record.

    However, your post is not really very clear.

    Did LTSB accidentally credit your card? Then they have tried to reclaim the amount?

    If this is the case, then it is legal. If you attempt to keep money that has been credited to your account, then this is theft and your actions are not legal.

    If you have a LTSB credit card and a bank account with LTSB they have a right of set off. ie if you owe on one they take from another.

    Since you knew the money credited to your card wasn't yours why did you accept the cheque rather than send it back?

    Even if they do not direct debt it from you.
    They can take you to the court and get it back from you.
    There are many success cases in the past
