boohoo no refund

Hi all
On Monday i placed an order for £70 with boohoo.com paid via paypal with next day delivery
I got home to a card through door saying package around back of house. Went to find it but nothing there.
I contacted boohoo who asked for details re door colour etc
Today they emailed me saying there are happy courier left it out of sight and have provided pictures of this so they will not settle
What do people think.

Personally I'd tell them that its irrelevant what they allow the courier to do - as that is an agreement between boohoo and the courier.
However they (boohoo) have failed to carry out their side of your contract with reasonable care by allowing their third party to leave the goods in an unsecure location and they cannot pass risk onto the consumer where the situation is (in practice) under their control.You keep using that word. Did you give any instructions to the courier/Boohoo for it to be left without a signature/in a 'safe' place?0

This is a copy of the last email from boohooAs stated on our website a signature may not always be required for delivery and if there is no one available to take delivery our carriers may attempt to leave it with a neighbour or in a safe, secure location. A card may be left to advise this to you, or to confirm that the parcel has been returned to the local depot. You can then contact them to arrange collection or to schedule a new delivery date.

I would e-mail them one more time pointing out that their couriers failed to leave the package in a "safe, secure location" as the very fact that it was stolen before you were able to retrieve it shows that it wasn't safe or secure.
If they still refuse a refund, then open a paypal dispute for non delivery of goods.
This won't be guaranteed to get you a refund as the couriers tracking facility may well show delivery which will be enough to win the dispute for them, and if this is the case, then legal action may well be your only other option.
A "letter before action" (you will find templates for this on Google), followed by moneyclaimonline application will hopefully be enough.0 -
Having sent a few emails. All i got were replies saying sorry you are not happy but seeing as it was delivered to the correct address and left secure then we will not process a refund. I fail to see how it was secure. Yes it was at back of the house but qas in plain site to anyone who went into garden.

I find myself in exactly the same predicament with Boohoo and they are doing nothing to follow up the fact that I have not received my parcel - x4 items of clothing meant as Christmas gifts for my daughter. Surely they cannot keep getting away with this?0
