all in one finance warranty invalid but still taking in our money :(

Hello hoping that someone may be able to help us.
We purchased a car from Carcraft (via trade in of our old clapped out one) on the basis that we wanted to start a family. When we purchased the car we was lead to believe that the loan had to be taken out alongside a warranty otherwise the transaction could not go through, thinking about planning ahead for a family and how difficult it would be if something went wrong and we couldnt afford to pay for it, we took out a 4year one.
We have being paying a monthly direct debit to the company all in one finance since 2010.
However when the car went seriously wrong and the computer failed, the warranty company said the cover was invalid - they stated you had to get the car serviced every year on exactly the same date otherwise it becomes invalid.... in 2012 the date fell on a Sunday, therefore it was serviced on the following Saturday instead?!
we ending up paying for all the car work on a visa card as we had no other way of paying and it was a huge cost. However when we said we wanted to cancel the warranty as we could not use it, they have told us we cannot cancel and have to continue paying until 2015? I have tried ringing Carcraft and they do not want to help.
Please can anyone who has expertise in this department please help us and let me know if we have any chance of cancelling this.

What do the terms state about cancelling the policy?
Most after market warranties are useless.
Bit late now but you should have taken the car in the week before if it fell on a Sunday.
You could argue the case that a service would not have any effect on that part. But they probably have a long list of excuses to not cover it.Censorship Reigns Supreme in Troll City...0 -
Presumably your payment is to a finance company who loaned you the money to buy the policy.
If that's the case, then they won't be able to help you cancel the warranty, or reduce your payments (as they will have paid the warranty company the cost when you first bought it).
As advised read up the warranty policy and see what it says about cancelling, and follow any instructions it gives on cancelling and getting any refund.0 -
For 6 days I would consider getting advice whether that clause is an unfair one in contract law.
You may get nowhere but you get nothing unless you ask - do you have legal assistance with your motor or home insurance?0 -
Yes we have legal cover I will look into that thank you for the advice and hopefully we can get it sorted.0

Same thing here,car craft presented me in nov 2011 the warranty mandatory and not optional , somehow I was forced to sign the contract, even on contract( sais optional) it is optional,as they say I need to have the 5 years ext warranty for the same period I took the loan.I did not know cancellation policy it is only 30 days as I though it is mandatory.
As I want to pay my car off, i called the company and the amount of 2000 pounds has been added to my contract , nice ....
I can not cancel the dd as it goes with the loan
Actions taken:
So I rang Car craft, and they said that I am out of cancellation policy,
I emailed Car craft -same thing
I email the citizen advice bureau-they only give legal advice
I called bank for a charge back on my cc but I am over 120 days
I complaint to ombudsman and I am waiting for reply
Next to do: complain to OFTA
and sue...which I do intend to do as they did not made clear the terms of the contract and they have lied to me about the warranty to get the contract signed.I'll take it to small claims court and submit online. Honestly , if you want to get a finance on the car with Carcraft, please take the contract home and read it carefully or go for a car loan at the bank.0
