Can a landlord ask a tenant to leave early?

My ex has given a months notice to vacate a property that he rents. The tenancy ends on 2nd June, but he is moving out on the 25th May and planned to use the remaining week to thoroughly clean the property, tidy the garden etc.

The new tenants came to view the house last week and were very pushy, wanting to know when he was moving as they wanted to get in as soon as possible.

Today, the landlord has texted my ex to say that he has told the new tenants that they can move in on 26th May!! He can't do that can he??

    Tell the LL that they can move in on that date provided
    a) the house is accepted in the current state with the LL accepting that there will be no claim for any damages
    b) full deposit is returned
    c) a good reference is given.

    Otherwise they have to wait until the formal end of the tenancy

    If he's paid up till 2nd June then his tenancy continues till then and the LL can't make him leave (or allow the new Ts to move in) earlier if he (your ex) doesn't want to. The LL can't rent the place to your ex and the new Ts at the same time.

    The LL might consider offering your ex a "sweetener" to leave early if he really wants the new Ts to move in on 26 May. But then that might lead to a whole other debate regarding the deposit etc., if your ex was planning to use the week to clean and tidy.

    This sounds like an ideal solution for all concerned.

    Make sure it is confirmed in writing though.
