Parking Eye

Hi,
I received a parking charge notice from parking eye and after spending hours reading threads and advice on this forum I am going to ignore it and any other invitations to pay, unless I get an unlikely court notice. However a couple of things trouble me about the this letter, namely:

a) the letter is to the keeper(my wife)and not to me the driver. nothing in the letter asks her to supply info on who the driver was.
b) the letter states "further to our recent parking charge notice this remains outstanding." I have never had any other letter or notice from them.
c) the letter is dated 6th of the month and asks for payment of £40 before the 10th to avoid a payment of £70. This letter arrived to 17th and the postmark is for the 16th.
d)the arrival and departure time are correct but are for two visits on the same day. I arrived, did a tiny bit of shopping and left after 20 mins. I was going home to drop of item that needed to be in fridge but due to large traffic jam, turned round and went back to car park, then went to appointment across the road as I was early I went back into the store and picked up an item I had forgotten.

I intend to ignore all letters etc other than a court notice. My defence would be I didn't over stay the time allowed, I made two visits. whilst this would be hard to prove, I am sure they couldn't disprove it either. I don't recall seeing any notices but I am going to check this to, whilst I am informing the store manager that they have now lost my custom. If there are notices displayed in the car park should they also have to state that cctv is being used etc?

Parking Eye have been given the vehicles keeper information from dvla. Do they have the right to disclose this info to PE.

Are they any pittfalls to my course of action that I need to be aware of and I would also appreciate any update advice on PE or PPC's

Many thanks for your help

Can I ask is this England or Wales ? If so you can make an appeal to the independent appeals popla if you were to challenge parking eye and they reject it.

Why don't you read post #40 here https://forums.moneysavingexpert.com/discussion/4488337

    Does that ring a bell?

Now research via Google a bit more and put in your POPLA appeal on the same basis, except for the spider!

Stickies are there for a good reason, and if people don't clog them up with normal comments and posts rather than actual results, then the real factual information can be got at without wading through hundreds of posts.

If in England/Wales you need to appeal this one and win at PE's expense, as they have to fund POPLA, only to see their fake PCN cancelled. Have fun with the initial appeal or word it however you like - but don't go it alone at POPLA stage.

Read any threads on the forum's first pages to find out more - but that link by Guy's Dad is classic.

This 'first in last out' scam is well known as the modus operandi of several parking companies (PPCs) and was specifically exposed by Watchdog:

You have been reading older threads if you think the answer is to ignore Parking Eye (unless in Scotland or NI). We now advise appeal & POPLA (with help).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Can anyone confirm the rules when it comes to Parking Eye charges in Scotland and whether they can enforce them please?

    Rules??!!

There no 'rules' and no 'appeal' in Scotland and you can ignore it completely, in the absence of actual Court papers - which won't come. It's a scam they can ONLY aim at the driver (and of course you don't respond; don't tell them who the driver was).

As per the Watchdog video, this describes the current situation in Scotland/NI:

I would advise that an appeal to the parking company and then popla thevindependent appeals when rejected should be considered. We can provide help with that. Or ignore the scam completely, though that comes with the small risk of them making claim.
