OK I'm starting to get a little worried... P.E getting more litigous, wait for the court papers etc... What is the likelihood of it going to court and I then also have to pay court costs?
Yes there was more than one machine on the site and they are clearly marked. I have parked there before... it has all come about that I assumed they had lengthened the time due to it being 2 days after xmas and madly busy.... Is this basically my own stupidity? I can't afford the £85 let alone court costs too!0 -

Oh get a grip, pleeease. A tiny % get a small claim and if you've read the threads with the small claims (minimal numbers!) you'll also have read there's a robust defence.
A small claim does not = a win.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

What concerns me is I have admitted to being the driver (I believe in being honest) and used a "this is what happened" reply.... From comments on here I'm screwed...

Nope. PE issue tens of thousands of fake PCNs and only a tiny % get a small claim.
AND YOU'VE MISSED THE MAIN POINT! A SMALL CLAIM DOES NOT = A WIN!!!
It's a shame you missed the POPLA chance and it was wasted - but it's not the end of the World that some law students (= POPLA decision-makers) thought your appeal wasn't enough. But you won't let that happen if you did need a defence, you'd come back and not write it yourself, yes?! Not just pay like a victim?!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I know they may not win but what will it cost if I loose?0 -
Stop worrying
Why do people not simply take the advice they are given
it wont cost very much should you loose, less then £200Proud to be a member of the Anti Enforcement Hobbyist Gang.:D:T0 -

If you loose? Lose??
You wouldn't lose because you'd put up a solid defence this time - we have template appeals waiting to be tweaked for people and so do pepipoo forums. It's frustrating that you tried a normal appeal at POPLA when you could have got advice and won it but I would hope you learnt from that not to go it alone with defences & appeals against these scammers?
But on the odd occasion when a naïve/stupid/uninformed person loses at County Court against a PPC (due to a lazy or weak defence or daft judge) they are normally ordered to pay the parking charge plus maybe £50/£100 expenses, costs and interest. You do not get any repercussions, not even a CCJ, as long you'd pay up after judgment.
It's a SMALL claim, the operative word in capitals tells you what sort of hearing it is, not a criminal or magistrates court, just one judge deciding if a person should pay a claim or not. That's how the small claims track works, it's for ordinary people to use and cannot include hefty solicitors bills or anything. We are NOT talking thousands!
Stop worrying.
