Stop paying the rent, he is not entitled to it anyway, it is now up to the council what they will do, I expect your daughter will get a notice stating that they want possession of the flat, but I would play it by ear until then, I am sure that she will get 28 days to leave, She can always declare herself homeless, if she leaves, It is the usual stock of the council housing, that if you voluntarily leave accommodation, before the bailiffs move in, then you have intentionally made yourself homeless, so play them at there own game, it is obvious that she thought it was legitimate, but she now no longer has to pay any rent to her supposed landlord.

KEEP THE RENT IN A BANK ACCOUNT, BUT DO NOT PAY THE LL

Find out if the deposit is protected. If not then thats likely to be lost, in that situation id pay over no more rent, and start looking for somewhere new. Hes unlikely to be in any position to chase after missing rent.

If he is getting Housing Benefit and living abroad whilst sub-letting, it is very unlikely that he has protected the deposit, if he has I will be truly amazed.
