Damaged delivery

Hello,

I bought some tiles from Travertine direct and these were delivered along with the adhesive in a large crate. The purchasing information said these must be checked and 'damaged' written on the advice note if any could be seen. As I was working, my Mum accepted delivery and checked the crate as best she could. However, when we inspected it later the same day, we discovered one was missing and one broken. I contacted Travertine Direct and after some emails, they have offered to either pay for the two tiles 'as a gesture of good will' or resend the tiles but I would have to pay for the delivery costs. Apparently this is because we did not put 'damaged' on the delivery advice note. I feel quite aggrevied by this as it was not possible for my Mum to check all of the tiles as they are extremely heavy and needed two of us to remove them from the crate. I do not want to accept the refund as I need the tiles but resent having to fork out delivery costs when it is their fault. Can anyone offer any advice? Thank you in advance.

    Providing it was a consumer transaction and you werent acting as a business, why not just tell them you want to cancel instead and that since the goods didnt conform to contract at point of delivery, they are responsible for return carriage costs.

    They may be more willing to replace the broken items free of charge then. If not, I'd advise its probably not the kind of company you want to do business with and it may be worthwhile sourcing the tiles (or an alternative) elsewhere and going ahead with the cancellation (in other words, you would be rejecting them outright under SoGA).

    Is this a UK based company?

    Signing the courier's PDA reader means the items have been delivered. It doesn't mean the items were received without any damage.

    Send a letter before action if they don't budge

    Signing for an item just means it's been delivered. You're not signing on the quality of the item delivered. So even if you found any faults or issues after signing for the delivery, you still have the same rights as with any faulty item.
