Bank delaying tactics

Yippee!!!! I won!!!!

Thank you Martin, perseverence really paid off, I now have a full refund and apology!!!!


I wrote to my bank to reclaim £210 and received £50 back, followed it with the 2nd letter and since then the bank has sent me a letter every 3/4 weeks delaying the final response. Has anyone experienced these delaying tactics and how did you deal with it? Not sure if I should go to small claims or forget the whole thing. Help/advice would be appreciated.

    Everyone has. The days when the banks and CCCs meekly paid up after a couple of well worded letters are long gone. However, you do still have to "go through the motions" to show the judge or FO that you have tried to resolve the matter. If you want to see delaying tactics, just wait until you issue the court claim!

    Just keep to the timetable in the article.

    If you don't want to take it to court, or can't afford the court fees and aren't eligible for court fee relief, you can escalate the claim to the Financial Ombudsman after 40 days. It isn't as reliable as going to court, though.
    The acquisition of wealth is no longer the driving force in my life. :)

    This is the second time you have said the FO isn't as reliable as going to court, what exactly do you mean by that? Have you experience of going through the FO as every user who has claimed via the FO have had a very positive experience :confused:
  • :mad: I recieved 2 letters todays from barclays who say they will looking into the complaint but it will take 4 weeks, on the 2nd letter they said it could be up to 8 weeks to get a response!!
    i have sent them the next letter stating i want a response in 7 days or i go to court, the problem is i cannot afford to do the court bit as i am now £1,000+ O/D!!:mad:

  • Thank you to all who have responded to my request for help, I have now received a letter from the bank saying that they still have not reached a decision and need more time to investigate my claim fully, they enclosed a Financial Ombudsman leaflet stating that I could puruse my claim through this method, any advice?

    Firstly don't threaten the bank with something you either won't or can't follow through with. They will call your bluff. These days you are pretty much guaranteed to have to file a court claim.

    If you really can't afford to go to court and if you aren't entitled to free court costs then what you are left with is a complaint to the Financial Ombudsman. It's a free service but you do have to wait 8 weeks from your first complaint to the bank. The 8 weeks is to allow the bank to try to deal with your complaint satisfactorily.

    Once the 8 weeks has passed write to the FO outlining your complaint and supply them with a detail list of charges (ie dates, amounts and reasons for charge). The FO will take on the bank on your behalf. It may be a long wait though as I presume the FO is starting to get as snowed under as the courts.

    If you don't want to go to court.

    Wait the 8 weeks from your first letter of complaint, if the bank has contacted you, or their offer is unacceptable write to the FO.

    Remember 8 weeks, not a minute less, not a minute more. The bank will do their best to con you into wasting more time.
