car insurance claims..... i need help on 2 counts!!!

firstly, my partners car (which im a named driver on) was hit by a local authority van whilst the car was parked outside. the driver drove off. we have an independent witness, but no reg number or other proofs. the claim was made, car is currently in being repaired, but we have been advised that the insurers will no longer be pursuing the case once the car has been repaired and the balance paid. so we lose the excess :( gutted! does anyone know, what will happen to the 10yrs+ protected NCB on the policy? im not sure im brave enough to ring and ask :/ and also, the vehicle will eventually be found as the authority is aware and has had no damage reports yet, but all vans are seen every 6 months, so would it be worth the hassle of attempting to prove it was said vehicle that hit our car, as and when its found?

next!............i was also involved in an accident (only a week and a half before the incident above...... hows that for bad luck?!) where the other driver entered a side road too quickly, over shot and ended up on the wrong side of the road, and in turn, wrote my car off! i have photographic evidence showing the damage to both vehicles, my vehicle position, position of the debris etc etc, and i also have a witness statement clarifying my version of events. however the other party is claiming that i swerved into them and also claims to have a witness statement clarifying their version of events. i have checked with my insurers this morning and they are still fighting the other insurer over liability, but what will happen next? i KNOW that i wasn't at all responsible, and i was quite confident that the photos would prove my case, however hearing that the other party have invented a witness, im beginning to think that they may have a leg to stand on when defending themselves.

    1) Your partner will lose one protected "life". 1b) Always worth it if you can prove who did the damage. (It changes the claim from a fault one (as it is currently) to a non fault, and you can pursue for your excess back too)

    2) All you can do is ensure your insurer has your side of the story together with your evidence and await the outcome.
