Warranty query - Amazon seller

Purchased a tablet on 12 May 2012 from an Amazon seller - emailed them on 5 May 2013 to report that it had no power. Seller sent an SD card out which he felt would fix the problem -sent 2nd class and so did not receive it until the warranty had expired, and did not solve the problem. Now says as the product is now out of warranty, I have to pay a consultation fee, and additional payments for any repair.

So, the question I have is - am I still under warranty because I have reported the fault within the warranty time, or is it a case of tough luck?

    The item was faulty within the warranty period and they should sort it out.

    Actually getting them to do this maybe harder. Do they still sell them?

    Yes, they are still selling them. Emailed them earlier in the year with the same issue, they immediately replied telling me to return it to them but the problem resolved itself. Obvious they've just used delaying tactics with it being so close to the warranty ending and I'm annoyed at myself for not pushing to return the item.
