Small Claim.

Hi there and apologies if this is in the wrong forum but was not sure where to look as this is the first time i have had to do this. So here goes.

My previous landlord has put in a claim with Money Claim Online saying i owe him £877. Which i dont.

Last month i moved out of a room in which i was a lodger. This was due to my then landlord claiming that i owed him money from rent arrears which i did not. he suddenly said i had 800 arrears after i had mentioned that i had gotten a new job which paid very good money. This was not true as i was only 2 weeks in arrears. Unfortunately as he would never give me receipts and never gave me a rent book despite asking for one on several occasions.

Another reason i moved was also because as i work nights i was not able to sleep due to him constantly making noise during day (he knew i worked nights). the final reason was because of a leak which i had told him about that never got repaired. This leak ruined my own personal property

Day before i moved i left a letter stating that i was giving him 24 hours notice(he had gone on holiday for the weekend) i also took photographs of the damage from the leak and said in the letter that i was keeping the last 2 weeks rent to recover the cost of damage to my property. this property was a surround sound system, Desktop Computer and monitor (damage from previous leak and slowly died due to this) an arm chair and some books.

On this claim that i have received today he has stated that
*i only told him about leak once - I told him Several times
*i left him a note acknowleding the debt - i acknowledged that i owed him 2 weeks only (i stated 2 weeks) in the letter of notice
*he states that i can present no proof of damage to my possesions or the leak. - I have photos which i can show if neccessary.

my question is do i have a leg to stand on and what advice can you give me either way

    Your damaged property should have been covered by your own contents insurance, so I doubt that you can claim this from your landlord.

    I suspect the outcome in court will be that you are found to owe your ex-landlord two weeks rent. And possibly his costs.

    If he says that you left a note acknowledging the whole £800-odd then you will just have to wait and see what he produces in court to back this up.

    In the meantime you should file your response to his claim with the court.
