IPhone 5 bought off e-bay in December/January, it has now been reported lost/stolen?

My boyfriend bought an iPhone 5 off E-bay in December/January 2012. In the last few days he couldn't make or receive calls or texts. He spoke to Orange and they said it had been reported lost/stolen and was now black listed. Obviously E-bay will do nothing as it is out of their 45 day policy, and Orange are now going through some fraud procedures... But is there anything else that can be done? Have read so many stories of this happening now, there must be a way to get some form of compensation, or at least the money back from the purchase. He has insurance from a separate company with the phone, will they be able to do anything about it?

Check it on CheckMend....then go to the police The original owner will get it back and if they have been paid by insurance then the insurance company is the owner of the phone and they'll get it back. You have to raise a civil court claim against the seller if you want a chance of getting your money back.

Do you know the name of the seller? If so, provide all the proof of your purchase to Orange, as if the seller and the person who's made the claim are one and the same, or if the seller is the original owner, you have a rather good case to have the phone unblocked.0

This happened to me a few years ago, but I was in the more fortunate position of having collected it from the sellers home address locally.
To say he was shocked when I knocked on his door is an understatement and I waited whilst he called T Mobile and apologised for his 'error', he then transferred the handset into my name.
Orange will be able to see that you have been making calls from this handset since you purchased it, that will go in your favour. You need to find anything relating to the transaction, emails, paypal receipts, insurance documents your BF has etc. Get this to Orange.
Your seller will have assumed that after 5/6 months you will have lost his details and has decided its time to fraudulently claim for a new phone.0
