Hi all,
I am shortly due to be resigning from my current workplace in order to change my career direction. My notice period is 1 week and this year I have 26.5 days holiday allowance (6.5 carried over from last year) so I have 2 questions:
1 - I am planning to hand in my notice next week Monday 20th thus giving my work 1 weeks notice. This would technically make my last day Monday 27th (which is conveniently a bank hol). From what i understand i can include this Monday 27th as part of my notice period as we are closed anyway. I could really make Friday my last day but i want to be sneaky and get a extra days pay by officially making my last day Monday. Am I correct in assuming the bank hol will count towards notice period?
2 - As mentioned i have 26.5 holidays allowance this year (Jan 1 - Dec 31). My basic holidays are just 20 days however i had 6.5 days carried over from last year. Since Jan 1st I have used 6.5 days, leaving 20 days left. My last working day will be 27th May. How many day holiday pay does this work out to? I have done various calculation based on week number, day number etc etc and all are differing. Plus i believe the figure worked out must be rounded up. So after calculating the holidays i am owed if i am left with 4.24 days for example, they must round it up to 5. Again if anyone can correct me on this i would appreciate it.
Just to add, i work Mon-Fri days a week. Bank holidays we are closed but i get paid for it. My basic holiday allowance is 20 days. So if you include the 8 bank holidays this makes 28 days in total which is the minimum they have to give.

It won't make any difference anyway, you'll either get paid for the day as part of your last month's salary or as part of any holiday accrued0 -
I suspect they'll call it Friday as the end of the working week, bank holidays aren't mandatory

Thanks for the reply. Yes, in reality my last working day will be Friday, as we are closed on the Monday regardless. However my point being we are all entitled to 5.6 weeks of holiday per year = 28 days a year.
Now i am contractually allowed 20 days per year of paid holiday. If you add the 8 bank holidays which fall in 2013 you get 28 days which is the MINIMUM they must offer.
Therefore i have 2 options:
1 - I make my last day Friday 24th, in which case i am owed an extra days holiday as i should have been paid for the bank hol as this is part of the minimum allowance they have to offer.
2 - Or i make monday my last paid day which means the only holiday pay i am due is the unused holidays ive accrued till the day i leave (Monday 27th).
Lets just say my colleague who will deal with the payroll etc is known to make blunders and stand by them. Its only until i can prove them wrong with facts that they will give in. I dont want to be the person who has to keep arguing my point therefore im trying to get the facts of what i am and am not entitled to. So when i do hand my notice in i can make this clear to them0 -
and i should add that from the information i have found.the 6.5 days which have been carried over do not count towards the minimum allowance. Therefore in a year (jan - dec) i will get 20 days basic holiday, 8 days paid bank holiday (so i have my legal 28 days) and then 6.5 days added to that.0

Depends how they calculate it
Presuming the 6.5 days is carried over OK and you've followed all rules relating to this [ i.e. If we carry days over, we have to use them by 31/3 or lose them]
You'll definitely be entitled to (28/12) 2.33 days for the first 4 months of the year so 9.3 [- anything you've already had, Good Friday, Easter Monday etc.] so that's probably 13.5 days all in.
As for May, our company pays you for the month if you have gone past the half way point, but doesn't if you don't. Presuming they do, you should get 14 days, maybe 15.
Bank hol Monday on the 27th is a red herring and it wont make any difference whether you leave Friday or Monday.0
