Sent wrong goods but denied refund as claim had to be made within 10 days

    Quick update on this - looking back I actually paid through paypal, so my first step was to open a dispute with them requesting a full refund.

    I included a message with this stating that I was confident that they weren't allowed to impose a limit on my return period when they'd sent me the wrong item, and that I was prepared to take them to the small claims court.

    When ebuyer received they completely changed their tune and have sent me an RMA number for a refund.

    Thanks for your help here everyone - good outcome!

    Not quite true, if say you used it for say 3 months you could be deemed to have accepted what they sent you. You couldn't use it for its life and then decide you want the money back.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    Interesting - citizens' advice bureau said I was actually covered for up to 6 years if I'd be delivered the wrong goods, but that if I'd say used the laptop for a couple of years I'd only be entitled to a partial refund, to be argued on a case by case basis.

    In these circumstances, 10 days seems to be a short enough period of time and I'm looking forward to my refund.

    In a final act of pettyness, I was told to log into my account to order RMA delivery. I tried to do so, only to find that ebuyer had cancelled it!

    If acceptance hasnt occurred, you can reject outright for a full refund.

    If it has, then (with wrong goods anyway) you may still be able to claim for a partial refund - to account for the difference in value. This is why its a case by case basis. And the longer it took you to notice, the less chance you'd be able to argue non-acceptance. Because if it was so important as to change your mind, you shouldve noticed it quicker. Not talking about you here btw, just theoretically.

    I used to deal with e buyer daily in my last job. Suffice to say, that I would never ever buy anything from them. I hope you get it sorted OP.

    It would indeed be a case by case situation. If you bought a laptop with a 750GB hard drive, but didn't notice for a year that they'd sent you the 500GB model, you probably wouldn't be entitled to a full refund. On the other hand, if you bought a 2m square fire blanket, and on using it a year later it turned out they'd only sent you the 1m square blanket, you probably would be entitled to a full refund.
