Help with PPI claim repaid more than 6 years ago?

I'm hoping someone might be able to give me some advice.
I had a loan with PPI attached from HSBC which was paid off more than 6 years ago. I was pressured in a face to face meeting into taking the PPI when I took the loan out. I found the loan agreement which has PPI clearly added to it (although it's called Credit Protection Insurance Loan) and sent it in to HSBC with the completed FOS form.
They've written back to me saying that they cannot find any evidence that Payment Protection Insurance was attached to the loan reference number I gave them. But they then say that as it's more than 6 years old, any records `may' have been destroyed. They then ask me to provide `documentation confirming the protection held and accompanying statements confirming the payments made'. They also advise that they are closing my complaint until they receive this.
I am very confused by this - how is the copy of the loan agreement not sufficient? And as my bank account is also with them, will they not just tell me that they can't provide me with copies of statements because they are older than 6 years??
I'd be really grateful for any help or advice as to what to do next.
Many thanks!

You are the one making the complaint so it's up to you to give them the info needed.
A copy of the loan agreement is not sufficient because you may have cancelled it or paid it off early.
You can either go online and see if you can download statements from that time or send them a SAR asking for statements from that time so you can prove you paid it all.
Because you are asking them to investigate again, the 8 week rule wil not apply when you have this information, so you could be waiting for months.Non me fac calcitrare tuum culi0 -
Hi SNW1976
I just got exactly the same letter.
I actually had PPI on a credit card that I paid off, but only found out about the whole PPI deal 10 years later.
I remember as though it was yesterday when I tried to make a claim as I had just lost my job and had a very tough 6 months (2002).
Is there a way to dig up this information?
As the information is not available online.
I don't want to go through a claim's company.
Thanks0 -

If you had PPI on a credit card, this would have been a separate amount on every single credit card statement.
Its doubtful they would have retained documentation after 10 years to be honest.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
Hi everyone
Just wanted to pop back and let you know that I was successful in my claim, and the bank upheld my complaint. I turns out that I didn't need any further information, in fact the bank told me that I could have made the complaint without even having the loan agreement. The letter they had initially sent me was because they were looking at an incorrect loan number, they did have records of both my loan and the PPI attached to it.
I rang the FOS helpline on a friend's advice, who told me that it wasn't at all necessary to have bank statements to prove I had made payments, and that they would contact my bank for me to discuss my complaint. They also told me that based on what I'd said, if the complaint came back to them, they'd be likely to uphold it.
The bank resolved it within 6 weeks and have paid out in full. So I would say don't be put off. I had almost given up hope because of the advice I was given (here included), which made it seem like I had no chance without lots more info.
Call the FOS if you're not sure, they were really helpful and got everything kick started again for me, and I am chuffed to bits with the result!0 -
i have been chased and chased by reclaiming companies about accounts that they reckon we can claim back on.
i have been in touch with hsbc regarding an old hfc loan account that was paid up in full years ago probably over 6 years ago.
i have sent letters to hsbc and all correspondence state that they dont have any records of our said account and that they only have to go back 6 years as keeping in with the law and data protection.
my question is can i ask for a full statement history and have i got any chance of getting all statements for that account.

If you have asked HSBC and they say they have no records, then that means they have no records. You can ask them for what you like but they can only supply what they have. If you dont believe them then spend £10 and do a data subject access request.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only.
