Credit Card - Debt Collectors

Hi all,

Please help...

Last September we took out a credit card with Laura Ashley to get a 10% off deal. We came away from the shop with a credit card agreement and £50 worth of goods.

Since then we have received nothing from them, no cards, no statements, no letters or phone calls... To be honest we forgot all about it because we didnt receive anything.

We received a call from Capquest debt collection agency the other day, stating that they have a letter for us from Santander, who the cards should come from.

We called Laura Ashley, who confirmed they have sold the debt to Capquest, and that they have sent lots of letters to our address. (When Capquest spoke to my wife they didnt seem to know out address).

I suspect that the cards and all the correspondence has gone astray (if there was any).

We don't mind paying the £50 for the goods, that's fair, but we really feel that we shouldn't be paying the extra £140 lumped on top of that.

Any ideas on how to proceed?

    So you bought goods last September and never once thought about where the card has been posted to or how you were going to settle the bill until you got a debt collector ringing you up 8 months later?

    Don't you think that leaves a certain amount of negligence on your part?

    You'd probably be well to just pay the £190 now before the costs increase further, and next time, if you don't get something you sign up for, ring up and ask where it is.

    You signed the CCA, so regardless of whether you got a statement or not, you are fully responsible for paying the statement value.

    Data subject request? ask for information on the account - as in what address they were actually writing to? was there any error on there part with the information that was captured? Do you have a copy of the agreement that you signed? as that may including what details you gave them..
