Paying off a charging order

I received a charging order several years ago against a property I jointly own.

The Land Registry record shows a restriction against the property requiring notification to be sent to the plaintiff's solicitors if there is any proposed change of ownership or beneficial interest.

I'm now in a position to pay the underlying CCJ and therefore to negate the charging order.

Does anyone know the process for removing the restriction? In particular is this something that I will be able to do myself? I suspect that the plaintiff's solicitors will try to extract more money from me for dealing with this and I dislike them enough to want to avoid this if at all possible.

    Is interest being charged? If no interest just leave it until you sell the property.

    No interest as I recall but this is a long and complicated story. Short version is that the property will become empty in the near future. I plan to rent it out rather than sell it and I hope to get a small mortgage to fund renovation works. The CCJ is about to drop off my credit file but the restriction would trigger questions from any lender.

    The original debt is also a legacy from a bad time and I would like to get rid of it any event.

    Please see this link to our Factsheet 5 which covers this topic and our Practice Guide 19 (section 4.7.2) explains what is required. You need to complete and lodge a form RX3 together with any supporting paperwork ie evidence that the Charging Order has been paid off.

    If you Contact Us we can give you some assistance to fill in the form if necessary but please bear in mind we cannot provide legal advice or guidance as to how to pay the Charging Order off or deal with either the Court or creditor.
