Hotpoint fridge freezer please help!

Hi
I bought a hotpoint fridge freezer ff200l in October 2009. It's become faulty as the fridge keeps getting warm. The freezer works fine. The only way to resolve the issue is to defrost it. I had a hotpoint engineer out today and he said that he had to 'modify' the appliance and cut a wire behind the control panel! My argument is that I shouldn't have to pay the call out fee as there is a fault with the appliance.
Any ideas?
