Consumer right regarding software download

Hello,
I purchased a game yesterday from the Nintento eShop.
After 22hrs the game has still not downloaded (its about half way done) and I think this is an unacceptable delay.
I have a high speed connection (120MB Virgin) and the Wii U is located next to my router - I'm techie enough to be fairly sure this isn't a problem at my end.
Would I be within my rights to request a refund? The law around digital purchases is confusing, but surely the software needs to be delivered before specific rules apply?

Email them and ask - as you haven't officially received them item its possible, but doubtful.
Are you using a wireless connection to download?
If so, use wired.0 -

More information needed to be honest.
Size of the game, how far it has downloaded (if at all), what were the terms and conditions you clicked agree to at the time etc.0 -
You can always request a refund. I'm not sure they'll agree though.
In addition, I suspect they are based abroad so to take any legal action you will need to be well versed in the law of that country.
You may just need to wait it out.0 -
I am with Thumbremote here. Also strict conditions that once the link is provided most dont refund, even if it is not attempted to download0
