I cant sleep

Hello

i have debts of around about 100k due to a bad marrige breakdown and stupid decisions. I have had this debt for 3 years , i moved house and buried my head in the sand but now have been found , Bankruptcy is inevitable but im worried about how it will affect me and my new parnter ,i have had no bank account for 3 years my wages get paid into a friends account and he gives me the cash , i live in a house rented off family , my basic pay is around 1300 pound a month but with overtime can be up to 2000 a month however ive been told now that overtime has stopped due to low work ,i want my partner to live with me but she cannot afford to pay half the bills i to be honest i dont want her too ,
my questions are

Can i still go bankrupt after waiting so long and without bank accounts?

last year i had a lot of overtime will that be took into account to my average monthly wage ?

can my partner still move in with me paying me just 100pm to cover increase in council tax etc ?

any advice will be greatly appreciated thank youi

    Yes you can still go BR. Why have you not got a bank account? Have you tried to open a Co-operative Cashminder account? I would open one of those and have your income paid into there. How are you currently paying all your bills if your income is given to you in cash by your friend? So much easier by direct debit or online once you have an account and you will get discounts when you pay that way.

    You can explain to the OR there is no longer overtime at work, that's fine. They will work out things on your current wage as written on your statement of affairs which needs to be accurate on the day you go BR so it is that day that matters. Then you notify the OR of any changes after that until you are discharged.

    No, the OR would expect your partner to pay their way if they lived with you. If their wage is less than yours then they are able to pay less than half the household costs, the OR would want to see evidence of their income if that was the case otherwise they assume they pay half.

    Do phone stepchange or national debtline or see someone at the citizens advice bureau to go through your options and help you decide whether BR is the best thing for you. The judge will want to know you have obtained debt advice from official sources like that.

    I have recently opened a basic bank account with Barclays , my bills are paid by DD from my friends bank account I am worried sick that my partner will stick with me as I will have no money for 3 years its keeping me awake at night

    Will I have to provide my friends bank statements ?

    I have literally no assets apart from my basics like telly DVD player and pc will these be taken?

    I have a company vehicle but its a small company and because I had 2 accidents my boss makes me do my own insurance , will the OR accept this ?

    Also I have to put personal fuel in can I include this on my spa

    unless you have antiques or valuables(usually over £1k) they wont take them prob wont even ask.

    Another question aswell then if I'm earning 1300 a month and my partners contributing 350 totalling 1650 will I be subject to an IPA ?
  • as suggested, you should contact national debtline who can answer all your Qs and advise of what will happen.
    You'll probably get that here too of course! but showing you're willing to address your problems should help

    It all depends on your SOA, you can post it up here for advice on what would or wouldn't be allowed.

    Firstly, get all of your income put into your Barclays account and set up your direct debits from there so it is all going through your own account.

    Ok thats my mission I will update you and post my SOA as soon as possible
    After reading through alot of these threads today and with the quick and helpful responses I'm not feeling so alone in this , so thank you :)
